“Fabricated and groundless”: Kevin Costner’s lawyer responds to Horizon stuntwoman lawsuit

Kevin Costner is facing yet another legal heat from Devyn LaBella, the stunt actress who accused him of allowing an unscripted r*pe scene during the production of Horizon: An American Saga – Chapter 2.

In the new legal filings, LaBella alleged that actor Roger Ivens tore her pantaloons “from the waist down to the crotch,” adding that she was menstruating on set.

She continued, claiming that she was pinned inside a concealed wagon without the presence of an intimacy coordinator.

The stuntwoman, who starred as a double to Ella Hunt's character Juliette Chesney, further said that the unscripted shoot differed from the previous day's sequence, which was supervised by a coordinator.

LaBella added that she felt "trapped" by Ivens' large build as he placed “his hand on or near [her] breast and v***nal areas."

However, Kevin Costner's lawyer, Mary Singer, has a grating response to Devyn LaBella, calling the accusations "ridiculous." In a new statement lodged on Monday, Sept. 8, he said:

“This may be a new filing, but it’s really just more of the same old nonsense. These claims are not only groundless, they are ridiculous. There are 12 independent witnesses who confirm that Ms. LaBella’s claims are fabricated.”

The attorner added:

“Kevin Costner has been very clear about why he refused to give in to a transparent shakedown. He is determined to stand up and fight for the truth — and we will continue to do so.”

Devyn LaBella previously shared text exchanges with intimacy coordinator, Celeste Chaney, calling the scene “an abomination.”

However, Kevin Costner, who stars as well as directs the movie, has provided photos to the Daily Mail on Aug. 19, where the stuntwoman is seen smiling with him. Other snaps feature her, clad in costume, and Ivens filming the scene.

Costner also exposed her messages, which he claims contradict her allegations. The May 11, 2023 text reveals LaBella thanking the crew for “these wonderful weeks," adding:

"I'm really happy it worked out the way it did."

The lawsuit comes as Horizon: An American Saga – Chapter 2 remains without a release date, more than a year after its poorly received Venice Film Festival premiere.

The second installment stars Sienna Miller, Sam Worthington, Luke Wilson, Jena Malone, Danny Huston, Jamie Campbell Bower, and others.

Despite the dismal reviews, Kevin Costner — who mortgaged property in Santa Barbara and invested $38 million of his own money into the two opening chapters — remains committed to expanding the franchise.

In a discussion with reporters about the Horizon's future installments, the veteran actor said:

“I have to hurry and not let the rock fall back downhill. I’ve gotta go put my hands on it again and start to push it up. It’s a rope that I cannot let go of."

He added:

“I don’t know how I’m gonna make 3 right now, but I’m gonna make it.”
