Stuntwoman Devyn LaBella, who last week sued actor/director Kevin Costner for an alleged unscripted r*pe scene on set during the shooting of Horizon: An American Saga – Chapter 2, is now being accused of being a “serial accuser” by Costner and his legal team.

The accusation stems from her previous connection to a lawsuit involving allegations of s*xual misconduct against the actor James Franco.

Devyn LaBella’s lawsuit, filed in Los Angeles in May 2025, claims that she was forced to perform a violent, unscripted, and unapproved r*pe scene without any consent or without sufficient preparation. She also pointed out the absence of an intimacy coordinator at the scene.

"I was left exposed, unprotected, and deeply betrayed by a system that promised safety and professionalism. What happened to me shattered my trust and forever changed how I move through this industry." LaBella had priviously stated according to The Guardian.

The scene was supposedly not revealed to her before filming, the complaint says that the scene had no rehearsals or safety measures. The set, she insists, was not secured and monitors were exposed to crew, a blatant violation of protocol.

Kevin Costner’s lawyer, Marty Singer, dismissed the claims as baseless and stated that they were refuted by LaBella’s behaviour. He cited a thank you text that LaBella reportedly sent a stunt coordinator after the scene, and said she gave a “thumbs up” sign of consent during a rehearsal.

According to Daily Mail, Singer also accused LaBella of using “shakedown tactics” and used her previous involvement in the high profile James Franco’s case as evidence of a pattern.


A deeper look into Devyn LaBella's involvement in James Franco's lawsuit

Devyn LaBella’s legal team and attorney Cassidy Geoghegan recently responded to Marty Singer’s claims by releasing an exclusive statement to the Daily Mail.

Her legal team stated that LaBella had never sued anyone before and had only appeared as an unnamed participant in the class action against James Franco as a former student of Studio 4.

She was reimbursed tuition, along with many more people, after Franco agreed to pay $2.2 million to settle a class action lawsuit filed in the wake of a number of accusations that said that the school had created a s*xually exploitative environment under the guise of teaching students how to act.

LaBella was quoted in a 2018 Los Angeles Times article describing how students would be led to believe that there were roles in Franco’s film available only to Studio 4 students, including some roles that involved nudity or performing s*xually explicit acts. Her attorneys stated that Devyn LaBella’s earlier participation in the Franco case should not affect her current lawsuit and its credibility.

"She has a glowing track record of consistent professional work, even on Costner's set," Cassidy Geoghegan told Daily Mail.

Devyn LaBella's attorney Kate McFarlane said that the stuntwoman's situation is indicative of a broader, systemic issue in Hollywood, where women remain at risk for exploitation.
