Actor Danny Masterson, who played the role of Steven Hyde in That ’70s Show, is looking forward to getting the r*pe charges and prison time dismissed. On November 17, he filed a petition for the same. He argued that his legal representative failed to do their due diligence by not bringing in important witnesses and other evidence that might have absolved him.Masterson was represented by Philip Cohen in the 2023 retrial. As an outcome of the trial, he was found guilty of r*ping two women, following which he got a 30-year-to-life sentence. According to Rolling Stone, he is currently held in a California prison. This goes back to 2003, and the incident took place in his house in Los Angeles. A mistrial in this case also happened in November 2022, after which the 2023 trial occurred.Through the new habeas corpus petition, Danny Masterson also claimed that the judge at the time permitted anti-Scientology evidence in his trial. Furthermore, he alleged that Cohen did not call a single witness during the trial, despite him identifying as many as 20 witnesses. The actor noted that Cohen should have adopted a different strategy when Claire Headley, a Scientologist, was called to testify. He alleged that Headley’s testimony was heretical. As such, Danny Masterson argued that another expert in Scientology should have been called in the case to assess Headley’s statements. Per his filing:“The jury saw only the tip of the iceberg of available defense evidence in the form of the complaining witnesses’ inconsistent statements while the wealth of directly exculpatory evidence went unused for no viable tactical reason. Masterson implored counsel to present at least a minimal modicum of defense evidence, but counsel refused.” View this post on Instagram Instagram PostWhat did Danny Masterson’s petition say about actress Leah Ramini’s testimony? The women who alleged that they were r*ped by the actor remained anonymous during the trial. They claimed that everything happened after they were dr*gged. Of the three women, he was convicted of violating two. One of the women was involved with the actor, and their relationship was not private. As mentioned, Danny Masterson also called out the judge’s bias in the case. He alleged that when Claire Headley was called in to provide testimony, it was a result of Judge Charlaine Olmedo’s judicial bias. Speaking of actress Leah Remini, who was also called to testify, the petition stated:“She was welcomed into the prosecution fold as an adviser, strategist, authoritative arbiter on the policy and practices of the Church of Scientology, and advocate for the complaining witnesses. She was welcomed even though the LAPD knew that she had an ongoing vendetta against Masterson.”Danny Masterson’s petition further read:“At the same time, the prosecution knew that her anti-Scientology television series would reap substantial publicity and financial benefits if petitioner were charged and convicted.”Eric S. Multhaup, the lawyer who filed the habeas corpus petition, mentioned there were several shortcomings in the second trial. He said the new petition provided several exhibits that could have proved Danny Masterson’s innocence but were never taken into account.
