Diddy is free from another charge that was filed against him. While awaiting sentencing, a civil sex assault suit that was filed against the rapper has been dismissed by a New York judge.

The music mogul was accused of reportedly drugging and sexually assaulting a then-23-year-old artist at a Los Angeles nightclub in 2015. The plaintiff filed the complaint in February about the alleged encounter wherein the victim expressed that an encounter with Sean "Puff Daddy" Combs ended with him passed out after drinking a beverage and then waking to an "unwanted sexual contact" with P Diddy.

Attorney Tony Buzbee, who filed the suit, also claimed that the "Last Night" singer threatened his future career if he resisted. When the suit was filed in February, the rapper's attorneys told TMZ back then,

"Mr. Combs cannot respond to every new publicity stunt, even in response to claims that are facially ridiculous or demonstrably false. Mr. Combs and his legal team have full confidence in the facts and the integrity of the judicial process. In court, the truth will prevail: that Mr. Combs never sexually assaulted or trafficked anyone -- man or woman, adult or minor.”

Judge's ruling on the Diddy civil suit

The New York judge dismissed the case against the rap mogul as well as his companies, Bad Boy Entertainment and Combs Enterprises, on the grounds that the claims were time-barred under New York law, meaning the statute of limitations on the incident was over, ruling in Diddy's favour.

A 2019 change in state law that extended the window for certain sex abuse claims to 20 years does not apply retroactively to this case, according to the judge, and hence could not revive the plaintiff’s case.

Sean Combs is currently in custody as he awaits his sentencing in the federal criminal case against him. According to court filings, his sentencing is scheduled for October 3.
