Alec Baldwin is slated to get deposed this May for his role in the October 2021 fatal accident of cinematographer Halyna Hutchins on the set of Rust.
Hutchkins' lawyers, hired by her family, informed the judge that they would be deposing the actor over the shooting on May 9 at their firm's office in New York, The Hollywood Reporter has revealed.
“It is long overdue for him to testify under oath about what really happened that caused the death” of Hutchins, said Gloria Allred, the family's attorney, in a legal statement.
The case against Alec Baldwin explored:
Olga Solovey, Anatolii Androsovych, and Svetlana Zemko, Hutchins’ mother, father, and sister, respectively, have filed the lawsuit against Baldwin, Rust Movie Productions, and the producers of the film. They are blaming them for the accidental shooting, citing repeated dismissal of safety protocols engineered to ensure that firearms would be used in a safe capacity on set.
The complaint claims that Alec Baldwin allegedly failed to check if the firearm was loaded and that it violates the standard safety protocols of the industry. They also accuse him of firing the gun despite not needing it for the scene.
The outlet has reported that the lawsuit is levying battery, intentional infliction of emotional distress, negligence, and loss of consortium against Alec Baldwin and the other co-defendants.
In the statement, Allred also slammed Alec Baldwin’s TLC reality series, which chronicles the life of him and his family for,
“ignoring the fact that [he] took a child away from her parents.”
“No longer under the threat of criminal prosecution, it is long overdue for Alec Baldwin to admit and face the real-life consequences that he caused Halyna’s parents and sister,” she said.
In a March 2025 episode of the show, Hilaria Baldwin reflected on the aftermath of the shooting and how it impacted her husband's life.
"I found these text messages the other day between us the day after (the shooting). And he said he wanted to kill himself," Hilaria told one of her friends during the episode. "He has survivor's guilt," she said in a confessional. "He goes back to that day; he wishes it were him. He would change places in a second."
She also revealed that he developed "heart problems" and was subjected to hospitalization "multiple times."
"Halyna lost her life in the most unforeseeable tragedy. This is never something to forget. This is never something to not think of," Hilaria said in another confessional. "This is about honoring a really incredible person for the rest of our lives and to pass on her memory to our children and our children's children."
However, that same month, Hutchins' family called the show out in a statement, as reported by USA Today:
"Alec Baldwin has compounded the pain of Halyna's parents and sister by taking advantage of his increased fame and notoriety by monetizing it in a TLC reality show, where he takes on the role of victim after he shot and killed Halyna Hutchins on the set of 'Rust,'" said Allred at the time.
Allred also accused Baldwin of failing to apologize to the family and has never taken responsibility for Halyna's death." She added: "Instead, he entered into a money-making deal with TLC."
"Is his reality show just a veiled attempt to create sympathy for himself with a future jury pool in our civil case? Is this just a shameless attempt to portray him as the real victim in this case?" She added, "Halyna’s parents' pain is magnified by the fact that Mr. Baldwin and his reality show treat Halyna's parents as though they are invisible. Alec does not acknowledge the need to be accountable to them for killing their daughter and he shamefully ignores the fact that, as a result of his disregard of gun safety protocols on the set of 'Rust,' Halyna will never be in the arms of her family, laughing and smiling again."
Just this January, Alec Baldwin sued Santa Fe officials, accusing them of malicious prosecution and civil rights violations for levying criminal charges against him in the same case. He accused prosecutors of concealing evidence that would acquit him, claiming that they conspired to charge him for political gain.
