Tory Lanez Suffers Setback as Court Rejects ‘Missing’ Gun Appeals in Megan Thee Stallion Case

The court ruled against Tory Lanez as he rallied to present new evidence in a motion to overturn his conviction.

Complex has reported that Tory Lanez, who is currently serving a decade-long stint behind bars for shooting Megan Thee Stallion, attempted to present two habeas corpus petitions. However, the California Court of Appeals rejected this motion on Tuesday (August 12).

Legal Affairs & Trials journalist Meghann Cuniff has reported that Tory Lanez presented two Habeas Corpus petitions: one was in reference to his driver failing to testify, and the other was about a new statement from a security guard for Kelsey Nicole Harris during the trial, per Complex.

However, the Canadian rapper's main appeal has yet to be ruled on and is scheduled for a verbal argument on Monday, August 18, at a court in Los Angeles.


The latest developments in Tory Lanez's attempts to overturn his conviction explored

As seen in tweets shared on X, court documents from the most recent proceedings read as follows:

“The Los Angeles Police Department still has custody and control of the firearm and the firearm’s magazine, as well as of all the bullet casings and fragments that were booked into evidence."

It was also suggested that Megan’s former best friend, Kelsey Harris, was the one to shoot her, though this idea was shut down as reports indicated that 90% of the DNA obtained pointed towards the shooter being a man.

“It could not have come from a female such as Harris,” the filings stated. “Under the circumstances, there is no basis to conclude that the prosecution acted in bad faith by failing to collect fingerprints or a DNA sample from Harris.”

According to Billboard, the filing further stated:

“Petitioner has failed to [show] that additional DNA testing would establish a claim of actual innocence. Both parties’ experts at trial agreed that DNA testing of the magazine showed none of petitioner’s DNA was present, and as to the gun itself the inconclusive findings could neither exclude nor include petitioner as a minor contributor to the DNA found on the gun.” “Petitioner essentially concedes that such a claim is ineffectual. The prosecution does not have a duty to collect evidence helpful to the defense.”

Tory Lanez was convicted in December 2022 for his involvement in the 2020 shooting. He was sentenced to prison in August 2023, when a judge convicted him of "assault with an automatic firearm, carrying an unregistered loaded firearm in a vehicle, and discharging a firearm with gross negligence." The rapper has reportedly been trying to appeal the conviction since 2022, to no avail.
