The "world's largest labor union representing performers and broadcasters" has reportedly sued Fortnite's developers, Epic Games. The SAG-AFTRA (Screen Actors Guild- American Federation of Television and Radio Artists) released its full statement and official filing to the National Labor Relations Board (NLRB) on May 19.
The official complaint was reportedly filed after AI-voiced Darth Vader was introduced as an NPC on May 16. SAG-AFTRA alleged that the developers of the game replaced their union-covered voice "without prior notice to the union or the opportunity to bargain." The statement added,
"Fortnite's signatory company, Llama Productions, chose to replace the work of human performers with A.I. technology."
SAG-AFTRA releases full statement on "Fortnite's Use of AI Darth Vader Voice"
SAG-AFTRA has filed an official complaint to the NLRB following the launch of AI-voiced Darth Vader on May 16. The NPC character allowed real-time voice chat interactions. According to Dexerto, Epic Games had to put parental controls on the feature after some users started using offensive speech.
According to SAG-AFTRA's official statement, they respect and support James Earl Jones' (the actor who originally voiced Darth Vader's voice) estate's decision. They noted,
"However, we must protect our right to bargain terms and conditions around uses of voice that replace the work of our members, including those who previously did the work of matching Darth Vader's iconic rhythm and tone in video games."
According to a statement released by Epic Games, they had sought permission from James Earl Jones' family before integrating the AI feature. The family noted
“James Earl felt that the voice of Darth Vader was inseparable from the story of Star Wars, and he always wanted fans of all ages to continue to experience it."
They added,
"We hope that this collaboration with Fortnite will allow both longtime fans of Darth Vader and newer generations to share in the enjoyment of this iconic character.”
It is unclear if Epic Games or Llama Productions have responded to SAG-AFTRA's allegations and if they will seek a legal counsel. In other news, the developers are also navigating a legal trial with Apple as the games continue to be unavailable for iOS users.
SAG-AFTRA has alleged that Epic Games and Lama Productions used AI on the union members' voice without prior notice and discussion. While the company respects the decision to continue James Earl Jones' legacy, they are standing by the rights of their members. It is unclear if Fortnite developers have responded to the recent lawsuit.
