The divorce between Sia and her estranged husband Daniel Bernard has taken a tense turn as they battle over custody of their young son. What seemed to start as an amicable split when Sia filed for divorce in March 2025 has now spiralled into a legal storm of mutual accusations and serious claims.

Daniel has asked the court for sole legal and physical custody of their toddler, arguing that Sia is unfit to parent. Meanwhile, Sia is fighting back denying his allegations and pointing to her ex’s alleged past investigation as she seeks to protect her son’s welfare.

What accusations did Daniel Bernard make against Sia?

In October 2025, Bernard submitted legal documents asserting that Sia is an “unfit and unreliable parent” who is still “struggling with substance abuse and addiction,” making her incapable of providing stable or safe care for their son. He claims that Sia was secretly hospitalised for two weeks in Los Angeles and tested positive for barbiturates and benzodiazepines without a valid medical explanation.

He further requests that Sia undergo random and regular drug testing and that her visitation with their child be limited to two-hour, professionally supervised sessions three times a week. Additionally, Bernard is seeking monthly child support of roughly US $77,245, and claims he has become financially dependent on Sia alleging she shut down their joint business, leaving him without income.

He portrays himself as the only safe and reliable parent: young, healthy, no history of drug or alcohol problems, and with no criminal record.

As for the response, Sia denies the claims of substance abuse, stating she has been sober for more than six months and has repeatedly agreed to drug testing while asserting that it was her ex who refused. She also points out that Bernard has been under investigation by the Los Angeles Police Department (LAPD) and the Department of Children and Family Services (DCFS) for alleged illicit child-pornography found on his computer hard drive an investigation she says, though closed as inconclusive, still gives her pause about unsupervised time between their son and his father.

Bernard denies any involvement in the child-porn matter and suggests that Sia “planted evidence” in order to restrict his parenting time. Together, these allegations reveal a custody dispute loaded with personal history, financial claims and concerns about both parties’ capability and risk. Daniel accuses Sia of ongoing substance-abuse issues, claims she concealed a hospital stay, and asks for full custody and large support payments. Sia counters by asserting she is sober, her son has been in her care all along, and contending her ex is attempting to weaponize past issues while being under investigation himself.
