In September 2006, Valley City State University senior Mindy Morgenstern was found murdered in her off-campus apartment, shocking the small town of Valley City, North Dakota. Her body was discovered by friends Toni Baumann and Danielle Holmstrom after she failed to respond to multiple calls that afternoon. The scene bore signs of a brutal struggle: a cloth belt was wrapped tightly around her neck, a broken kitchen knife was lodged in her throat, and Pine-Sol cleaning fluid had been poured over her body, suggesting an attempt to destroy evidence.
Gibbs had a prior conviction for attempted murder in the 1990s and had changed his name in 2005. After a first trial ended in a hung jury, he was convicted in a 2007 retrial and sentenced to life without parole.

Discovery of the Crime

On the evening of September 13, 2006, Baumann and Holmstrom grew worried when Mindy failed to answer calls for hours.
“I ran inside and knocked on the door and there was no answer; it wasn’t locked and so I opened the door and stepped in,”
Baumann later told Oxygen’s An Unexpected Killer. Inside, she saw Mindy lying on the floor with a belt tied tightly around her neck and a broken knife still in her throat. The friends screamed for help, and a neighbor, Robert Linz, rushed in to check for a pulse while one of them called 911.
Evidence at the Scene of Dateline
Law enforcement officers arrived to find strong fumes of Pine-Sol in the hallway and on Mindy’s clothing.
“The body of the victim was lying across the entry hallway,” Special Agent Mark Sayler of the North Dakota Bureau of Criminal Investigation recalled.
Forensic teams collected fingerprints, hair strands, and crucially, DNA from under Mindy’s fingernails, where assailant cells often lodge during a struggle. Investigators also recovered Mindy’s purse, keys, and personal items untouched, ruling out robbery as a motive.
Arrest of Moe Gibbs

Neighbor Moe Maurice Gibbs, then a 35-year-old corrections officer at Barnes County Jail, became a suspect when his DNA matched samples from the crime scene. Born Glen Dale Morgan Jr., Gibbs had served time for a 1994 drive-by shooting and had been accused of sexual assaults by female inmates while on duty.
During questioning, he claimed he only entered Mindy’s apartment to help carry laundry, but police noted his story shifted under further scrutiny. He was arrested days later and charged with first-degree murder.
Trials and Convictions in Dateline
The first trial in late 2006 ended with jurors unable to agree on a verdict, leading to a mistrial. In July 2007, a retrial commenced, focusing on the DNA evidence, testimony from a jailhouse informant who said Gibbs confessed, and records of his violent past.
On November 20, 2007, the jury found Gibbs guilty of first-degree murder, and the court imposed a life sentence without the possibility of parole. His appeals were denied, and he remains incarcerated at the North Dakota State Penitentiary.
