Influencer Emilie Kiser and her family have made headlines after prosecutors announced that her husband, Brady Kiser, will not face charges in the tragic drowning of their son, Trigg. As reported by NBC News on Friday, July 25, 2025, officials stated that the evidence did not meet the legal threshold required to pursue criminal charges.
The drowning incident took place back on May 12, 2025, when Trigg was found unresponsive in the family’s backyard pool, after his father, Brad, was briefly distracted taking care of Trigg's infant brother, Theodore. Trigg was hospitalized and died on May 18, after six days of hospitalization.
Brady Kiser acquitted of charges in son's drowning case
In May 2025, after Brady lost sight of Trigg for a few minutes, he found the toddler unresponsive in their family's backyard pool. He had then called 911; however, Trigg died at the hospital on May 18.
The case was then investigated by the Chandler Police Department, and they recommended a Class 4 felony child abuse charge against Brady, citing alleged negligence. However, as per People, the Maricopa County Attorney’s Office reviewed the case and decided not to move forward with prosecution, stating that the evidence did not meet the legal standard required to prove negligence beyond a reasonable doubt.
Attorney Rachel Mitchell announced on Friday that Brady will not be charged ''because there is no reasonable likelihood of conviction.'' The statement on the Maricopa County Attorney's Office website read:
''Surveillance video from outside the home showed how the drowning occurred and the actual timeline of events. In order to convict a person of this charge, the state has to prove beyond a reasonable doubt to a unanimous jury that the person failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show.''
The statement continues:
''Noting that every case submitted to the office for review is evaluated on whether there's a reasonable likelihood of conviction. After careful review of the evidence submitted by Chandler PD, it was determined this case does not meet that standard."
The couple has not spoken publicly about the tragic accident, and further details of the case have not been made public.
