Lil Durk is now confronted with another legal issue in his current murder-for-hire case, as prosecutors have officially charged him with stalking, causing death. So, now a stalking death charge has been added to the murder indictment. According to the Chicago Tribune, this new charge was presented on May 1 in a superseding indictment.

In addition to it, prosecutors also submitted a supplemental motion denying Lil Durk's request for release and challenging arguments from his lawyers that the case is unfairly targeting his lyrics. The revised indictment charges the rapper with organizing the August 2022 fatal shooting of Saviay'a "Lul Pab" Robinson, a man affiliated with competing rapper Quando Rondo.

What does the new indictment say?

A fresh federal indictment has been brought against Lil Durk, stripping earlier claims that his songs were connected to the August 2022 death of a relative of a competitor in Los Angeles. The revised indictment adds a new 'stalking leading to death' charge, which, under some circumstances, can be a life sentence.

This second superseding indictment arrives as Lil Durk's defense team continues to dispute the charges, most notably those surrounding his lyrics, which they maintain were released months before the crime.

In spite of the amendment, Lil Durk still sits in federal custody in Los Angeles and will be arraigned on the revised charges, his attorneys again advocating for his release on bail until trial. The prosecutors wrote in a filing on Friday:

"Defendant Banks has presented a false narrative that he is being prosecuted and detained because of his violent lyrics. This claim is, and has always been, baseless. … He should remain detained pending trial."

What does Lil Durk's family say regarding the incident?

Raising a grave alarm about the course of the case, Lil Durk's relatives released a statement on April 29 condemning the authorities for, allegedly, abusing his lyrics as part of the indictment. They contend that artistic expression is being misrepresented as factual evidence, alleging the indictment was constructed on false information.

In the words of the statement, this action from the government not only does violence to truth but also degrades the dictates of fairness and due process. Calling the issue a breakdown in the justice system, the family was visibly disappointed, declaring that the process that serves to secure justice is now instead being weaponized.

With Lil Durk still behind bars pending trial, a statement uploaded on his Instagram page resists the charges, blaming the government for relying on deceptive evidence to obtain the indictment. The message asserts that the justice system has been tainted, with the prosecution having misled the grand jury.

It also puts the case into context as an even larger one of systemic failure by arguing that what's being done to Lil Durk represents a corruption of the justice system that was supposed to cover everyone. His lawyers seem to be basing their defense on undermining the believability of the evidence given. The video on Instagram explained:

"The recent developments in Durk’s legal case have brought a harsh truth to light: the government presented false evidence to a grand jury to indict him. This isn’t justice. That’s a violation of the very system that’s supposed to protect all of us."

It continued:

"Durk has always used music to tell stories, to express pain to heal, and yet those same lyrics are now being used against him. We refuse to stay silent as Black artists continue to be criminalized for their creativity. Rap is art. As a family, we are asking the public, the fans, and the culture to stand with us. Stand for truth. Stand for fairness. Stand for The Voice."

Lil Durk faces charges and stays focused during legal battle

Since his October 2024 arrest, Durk Devontay Banks, "Lil Durk",has been caught up in a complicated federal case that's garnered national attention. Indicted officially a month later on several serious charges, murder-for-hire via interstate facilities, and weapon-related charges related to a deadly shooting, Lil Durk has asserted his innocence.

His lawyers have pushed against the prosecution's narrative, particularly their references to his own lyrics as evidence. Lawyer Drew Findling pointed out that the song referenced by prosecutors, "Wonderful Wayne & Jackie Boy," was released months before the crime supposedly occurred, making it difficult to connect the song with the crime.

Even after pleading not guilty, Lil Durk was denied bond in December 2024. While behind bars, he's been vocal and called DJ Akademiks to give updates to the fans, promising fans he's remaining mentally and spiritually strong, even taking time to learn Arabic and reflect on family and personal development. In Lil Durk's words:

"I've been good, man. Mentally, spiritually, I been on top of my sh*t. I’ll be back out there, you hear me? Thank you, I need all the prayers. I appreciate you."

He continued,

"Ain’t nothing changed, bro. I've just been focused on life, my family. I’m trying to learn Arabic in here…A couple of guys in here who know how to speak Arabic fluently, so I’ve been picking up words, just tightening up my Arabic. Just building knowledge."

Rap lyrics removed from indictment amid legal pushback

In a small win for Lil Durk, the new indictment has eliminated the previously mentioned rap lyrics, which prosecutors originally claimed were linked to the murder.

This deletion follows after Lil Durk's attorneys vehemently protested the use of his lyrics as evidence, stating that they were being unfairly targeted and taken out of context.

The defense suggested that such a charge dilutes artistic expression, and their protest appears to have had some effect on the change of charges, an indication of a small but significant change in the legal process.

Lil Durk faces multiple murder-for-hire charges and links to other alleged crimes

Lil Durk, 32, was indicted in October on charges of masterminding a murder-for-hire scheme against rapper Quando Rondo, born Tyquian Terrel Bowman, in retaliation tothe 2020 shooting death of his close friend, King Von.

Prosecutors say Banks allegedly hired five members of his rap crew, Only the Family, to commit the murder and promised "lucrative music opportunities" to the participants.

Banks entered a plea of not guilty in November to the charges. The indictment recounts the shooting incident, during which Bowman, his sister, and cousin Saviay'a Robinson were attacked by shooters at a West Hollywood gas station. Bowman and his sister were not injured, but Robinson, 24, was shot and killed.

After the charges against his co-defendants were unsealed, Banks was apprehended last month near an airport in Florida. Prosecutors alleged that moments before his arrest, he had reserved seats on three international flights.

Last December, Banks was connected to another alleged murder-for-hire plot, this one for the 2022 shooting of Stephon Mack, 24, when he exited the Youth Peace Center of Roseland.

Even though Banks has not been indicted in the death of Mack, the FBI has indicated that Banks was making money offers for the deaths of those who had participated in the murder of his brother, raising the possibility that it was a gang-related act.

Lil Durk has a hearing coming up on May 8 that will decide whether he'll be released from jail prior to trial.
