In December 2023, Vin Diesel’s ex-assistant filed a sexual battery, retaliation, and wrongful termination lawsuit against the actor-filmmaker.

On Wednesday, Judge Daniel M. Crowley dismissed the case at the Los Angeles County Superior Court. He cited in his 13-page ruling that the alleged 2010 assault took place in Atlanta, Georgia, and had no legal standing in California.

The plaintiff, Asta Jonasson, is a novelist and development executive for both film and television projects.

“It is undisputed that the alleged sexual assault took place in Atlanta, Georgia… based on an alleged violation of a California statute, it fails as a matter of law because California statutes are presumed not to have extraterritorial effect unless the Legislature expressly states otherwise in adopting the statute,” Judge Crowley noted.
He added, “Plaintiff’s causes of action impermissibly apply California law to extraterritorial conduct in the State of Georgia. California authorities make clear that California law cannot be applied to any of the plaintiff’s claims.”

According to Deadline, Asta Jonasson’s civil suit was filed in California under the Sexual Abuse and Cover Up Accountability Act, amid the recent expiration of the statute of limitations.

Jonasson’s attorney, Matthew Hale, told the publication that her client would “appeal” against the dismissal.

“The Court did not decide anything about the truth of Ms Asta Jonasson’s allegations. The ruling was based on a legal technicality, with which we respectfully disagree. Ms Jonasson intends to appeal.”

All about Vin Diesel’s accuser, Asta Jonasson

Asta Jonasson is a writer and producer in Hollywood. She was born in Singapore to a Chinese mother and an Icelandic father. Currently, she has dual citizenship of the USA and Canada and divides her time between Los Angeles and Vancouver.

Jonasson graduated from Simon Fraser University with a double major in psychology and criminology. Later, she worked in a top-tier production company for over a decade and produced Emmy-winning scripts, documentaries, animated films, motion pictures, TV shows, OTT projects, and alternative programming.

She is also a published novelist who has released a novella titled The Mysterious Death of a Woman.

It remains unclear when Asta Jonasson worked for Vin Diesel. However, the former employee was primarily hired to organize parties and accompany him to events in the absence of his girlfriend.

According to her lawsuit, the actor sexually assaulted her in his suite at the St. Regis Hotel in Atlanta in September 2010, after a night of clubbing. At the time, Vin Diesel was filming for Fast Five.

“Ms Jonasson struggled continually to break free of his grasp, while repeatedly saying no. Vin Diesel is physically larger and much stronger than Ms Jonasson, and abused his position of authority as her employer, and was able to easily overpower Ms Jonasson,” the original filing claimed.

According to Asta Jonasson, in the aftermath of the alleged assault, her ex-boss’ sister, Samantha Vincent, kicked her. Later, she was “fired for courageously resisting” Vin Diesel’s advances. While he remained “protected,” the alleged assault was “covered up,” as per the lawsuit.

Back in 2023, Vin Diesel’s attorney Bryan Freedman denied the allegations on behalf of his client.

The original lawsuit consisted of ten claims. In June 2025, four of the claims, including creating a hostile work environment, discrimination, retaliation, and failure to prevent harassment, filed under California’s Fair Employment and Housing Act, were dismissed. The judge mentioned that the plaintiff needed to file a complaint with the state’s Civil Rights Division within a year of the alleged incident, calling it an “incurable procedural defect.”

On November 19, the rest of the accusations, including sexual battery and causing intentional emotional distress, were also thrown out by Judge Crowley after he heard both parties earlier this month. The case would no longer go to trial.

It is noteworthy that Jonasson’s lawyer, Matthew Hale, argued that although the alleged assault happened in Georgia, the case had merits in California, considering both the plaintiff and the defendant are citizens of the Golden State.

Hale also mentioned that Asta Jonasson was hired as Vin Diesel’s assistant by his Los Angeles-grown production company, One Race Productions, which is the actor’s co-defendant in the case alongside its President, Samantha Vincent.

Meanwhile, Vin Diesel’s attorneys Sean Hardy argued that the alleged assault happened outside California and had no merit in the state. After Wednesday’s ruling, Hardy told Deadline that his team was “grateful” that the lawsuit was dismissed and the matter was “resolved entirely.”

Notably, Asta Jonasson had signed an NDA after being terminated from her job. However, the Speak Out Act allowed her to address the alleged incident.
