Amidst the Epstein list drama, Ghislaine Maxwell’s family released a new statement on Tuesday, July 15, 2025.
The official press release asserted that the financier and convicted sex offender’s former associate is prepared to challenge her imprisonment. Ghislaine Maxwell’s siblings claimed that their sister “did not receive a fair trial.” They wrote,
“Her legal team continues to fight her case in the Courts and will file its reply in short order to the Government’s opposition in the US Supreme Court.”
The statement mentions that Ghislaine Maxwell and her family “will also file a writ of habeas corpus,” if necessary. It continues,
“This allows her to challenge her imprisonment on the basis of new evidence such as government misconduct that would have likely changed the trial's outcome.”
The family is prepared to file the writ in the United States District Court for the Southern District of New York (USDC SDNY). Ghislaine Maxwell’s trial was held at the Thurgood Marshall United States Courthouse, a part of the US District Court SDNY.
According to USCourts.gov, a writ of habeas corpus is a court order that requires law enforcement authorities to produce a person in their custody before a judge. The judicial summons and court appearance are made “to justify the prisoner's continued confinement.”
Ghislaine Maxwell’s counsel mentions her former boss’ non-prosecution agreement amid the Epstein files controversy
In October 2007, the disgraced financier signed a plea deal, also referred to as a non-prosecution agreement. It led to his conviction on two charges, and a 13-month prison sentence. While he was registered as a sex offender, the agreement reportedly covered his co-conspirators against prosecution.
In an April 2025 filing, Maxwell appealed against her conviction and 20-year sentence. Her lawyers referred to Jeffrey Epstein’s non-prosecution agreement in the petition. They wrote (via ABC News),
“Despite the existence of a non-prosecution agreement promising in plain language that the United States would not prosecute any co-conspirator of Jeffrey Epstein, the United States in fact prosecuted Ghislaine Maxwell as a co-conspirator of Jeffrey Epstein.”
In her family’s recent statement, they also shared the comments from Ghislaine Maxwell’s counsel, David Oscar Marcus. He addressed President Donald Trump,
“I’d be surprised if President Trump knew his lawyers were asking the Supreme Court to let the government break a deal. He’s the ultimate dealmaker — and I’m sure he’d agree that when the United States gives its word, it should keep it.”
He added,
“With all the talk about who’s being prosecuted and who isn’t, it’s especially unfair that Ghislaine Maxwell remains in prison based on a promise the US government made and broke.”
For the unversed, Maxwell’s family has issued the statement a week after the DOJ and FBI’s memo on the Epstein list. The Justice Department and the federal agency, in their joint press release, claimed that the deceased financier didn’t maintain an incriminating client list to blackmail high-profile figures.
The conclusion of the FBI's probe into the controversial case and conspiracies around the Epstein list also sparked MAGA backlash for the Trump administration and the US Attorney General, Pam Bondi. However, the US President came in support of the prominent GOP figure on Truth Social and urged the MAGA loyalists to remain united.
